ONE of the issue raised by Philip Shuaibu and his co travellers was the user thrashed by the trial court which was that the Appellant did not satisfy the condition precedent of (internal dispute resolution mechanism) before instituting the action therefore the suit was premature.

The court of appeal held that The Appellant (Philip Shuaibu) the impeached duty of Governor of Edo State, failed to comply with provisions of Article 9 (g) (h) (i). Which clearly stipulate the condition precedent that must be complied with before filing an action in court.

That Failure to comply with the provision of Article 9 (g), (h) and (i) is not one that can just be glossed over as it goes to the issue of jurisdiction. The suit was therefore adjudged premature. The position hitherto held by the lower court is unassailable. Therefore the issue is resolved against the Appellant (Philip Shuaibu) and in favor of the Respondents.(PDP & Asue Ighodalo)
